⚠️ CBD Warning: 81% of Clearinghouse Violations Are Positive Drug Tests

Saw some important data from FMCSA and wanted to share with the community.

The Numbers Are Sobering:

  • 81% of ALL Clearinghouse violations are positive drug tests
  • Over half of those are marijuana positives
  • CBD products are a MAJOR contributor

The CBD Problem:

Here’s what FMCSA says directly: “CBD use is NOT a legitimate medical explanation for a laboratory-confirmed marijuana positive result.”

That means:

  • Using CBD products = rolling the dice on your career
  • Many CBD products contain trace THC
  • “But it’s legal” doesn’t matter for DOT testing
  • You WILL show up in the Clearinghouse

2026 Testing Rates:

Random drug testing rate stays at 50% (unchanged since 2020)
Random alcohol testing rate stays at 10%

Coming Changes:

  • Fentanyl testing panel - Expected Q1 2026
  • Oral fluid testing - Rolling out late 2026
  • Clearinghouse data expansion - Proposed changes by May 2026

Bottom line: If you’re using ANY CBD products, you’re risking your CDL. Period.

This is HUGE and I wish more drivers understood it.

I’ve seen too many good drivers lose their careers because they thought CBD was “safe.” It’s not worth the risk.

My advice: if the label says CBD, THC-free, hemp, or anything in that family - stay away from it. The testing can’t tell the difference between “legal” CBD and marijuana.

40 years in this industry and I’ve never needed CBD to get through. Plenty of other ways to manage pain and stress on the road.
